Rules governing access to and use of the Medurance platform

⚠️ By using this platform, you agree to the terms below. Please read carefully before proceeding.

These Terms of Use (“Terms”) govern your access to and use of the mobile application “Medurance”, the websites www.medurance.in and www.medurance.co.in, and all related digital platforms, services, and content (collectively, the “Platform”).

The Platform is owned and operated by Medurance Private Limited, a company incorporated under the laws of India, having its registered office at Sector 35, Shipra Path, Mansarovar, Jaipur – 302020, Rajasthan, India (“Medurance”, “We”, “Us”, or “Our”).

1. Acceptance of Terms

By accessing, browsing, downloading, installing, registering on, or otherwise using the Platform, you (“You”, “Your”, “User”) acknowledge that:

  • you have read, understood, and agreed to be bound by these Terms;
  • you agree to comply with all applicable laws and regulations; and
  • these Terms constitute a legally binding agreement between You and Medurance.

If You do not agree with these Terms, please discontinue use of the Platform immediately.

Medurance reserves the right to modify or update these Terms at any time. Continued use of the Platform after such changes shall constitute Your acceptance of the revised Terms.

2. Scope of Services

The Platform provides assistance, facilitation, and informational support related to health insurance claims and allied services. Medurance does not provide medical treatment, diagnosis, or insurance underwriting services.

3. Eligibility

By using the Platform, You represent and warrant that:

  • You are at least 18 years of age and competent to contract under Indian law; or
  • You are accessing the Platform under the supervision and consent of a legal guardian.

4. Content Ownership and Usage

All content available on the Platform, including but not limited to:

  • text, data, graphics, images, illustrations;
  • articles, guides, newsletters, opinions;
  • audio and video clips;
  • trademarks, logos, and brand identifiers;
  • software, design, layout, and source code,

is owned by or licensed to Medurance and protected under applicable intellectual property laws of India.

Restrictions

You shall not:

  • copy, reproduce, distribute, publish, transmit, modify, or exploit any content;
  • use content for commercial purposes;
  • remove proprietary notices,

without prior written permission from Medurance.

5. Medical and Informational Disclaimer

  • Content on the Platform is provided for general informational and educational purposes only.
  • It is not a substitute for professional medical advice, diagnosis, or treatment.
  • Always seek advice from qualified medical professionals regarding health-related issues.

Medurance does not guarantee the accuracy, completeness, or reliability of any medical or third-party information available on the Platform and disclaims all liability arising therefrom.

6. Limitation of Liability

To the maximum extent permitted by law, Medurance, its directors, officers, employees, advisors, affiliates, and partners shall not be liable for any:

  • direct, indirect, incidental, special, consequential, or punitive damages;
  • loss of data, revenue, profits, goodwill, or business;
  • health-related outcomes, misinterpretation of reports, or delays in treatment;
  • system failure, malware, or viruses,

arising out of or related to Your use of or inability to use the Platform, even if advised of the possibility of such damages.

7. User Communications

Any communication submitted by You (including feedback, comments, suggestions, or queries):

  • shall be deemed non-confidential and non-proprietary;
  • may be used by Medurance without restriction for lawful purposes.

8. Third-Party Links and Services

The Platform may contain links to third-party websites, advertisements, or services. Medurance:

  • does not endorse or control such third-party content;
  • is not responsible for their accuracy, policies, or practices.

Your use of third-party services is entirely at Your own risk and subject to their respective terms.

9. Beneficiary & Insurance Guidelines

  • All insurance benefits, coverage, exclusions, limitations, and claim procedures are governed solely by the respective insurance policy terms.
  • Information provided by Medurance does not override policy documents.
  • In case of dispute, decisions taken by Medurance in accordance with its internal processes and applicable laws shall be final, subject to legal remedies available under Indian law.

10. Indemnity

You agree to defend, indemnify, and hold harmless Medurance and its affiliates from and against any claims, damages, liabilities, losses, costs, or expenses arising out of:

  • Your use or misuse of the Platform;
  • violation of these Terms;
  • infringement of any third-party rights;
  • submission of false or misleading information.

11. Termination

Medurance reserves the right to suspend or terminate Your access to the Platform at its sole discretion, without notice, for violation of these Terms or applicable laws.

12. No Waiver

Failure by Medurance to enforce any provision shall not constitute a waiver of its rights.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Courts at Jaipur, Rajasthan shall have exclusive jurisdiction over all disputes.
